Learnbird LMS Terms of Service

1Platform Services & Workspace Tenancy

Learnbird provides a multi-tenant Learning Management System (LMS) Software-as-a-Service (SaaS) platform that enables educators, tutoring institutes, and training academies to host courses, schedule recurring live classes, manage enrolled students, and track attendance.

• Subdomains & Custom Domains: Each academy receives a dedicated portal address (e.g., academy.learnbird.lk) or may configure a custom domain (e.g., academy.lk) on supported tiers.
• Batches & Cohorts: Batches serve as virtual separation groupings to isolate courses, live schedules, and student access rosters. Paid tiers include unlimited batch creation within total student and storage allocations.
• Service Availability: We strive to maintain 99.9% uptime for core LMS infrastructure, excluding scheduled maintenance announced in advance.

2Academy & User Accounts

Academy administrators are responsible for all activity conducted within their workspace:

• You must provide accurate, verified contact and legal information during onboarding.
• You are responsible for safeguarding login credentials and assigning appropriate role permissions to instructors and assistant staff.
• Account sharing, reselling tenant workspaces, or subleasing platform access to third parties without authorization is strictly prohibited.

3Educator Content Ownership & Intellectual Property

By uploading content, you grant Learnbird only the limited, non-exclusive technical license required to encode, transcode, store, and stream your media to your authenticated students via adaptive HLS streaming and secure CDNs.

4Student Tuition & Payment Processing

Learnbird LMS operates as software infrastructure, not a commercial broker:

• Direct Tuition Collection: Educators set class fees independently and can accept payments via direct bank transfer slips (manual/automated approval) or by linking their own payment gateways (e.g., PayHere, Stripe) with zero platform fees from Learnbird.
• Optional Managed Processing: If an educator explicitly requests Learnbird to handle card transactions and automated student payouts, a standard 5% platform handling fee applies only to those processed transactions.
• Student Relationship: Enrolled learners are students of your respective academy. Tuition refund policies, disputes, and fee adjustments are governed directly between the academy and its students.

5Live Classes & Zoom Integration

Learnbird LMS integrates with Zoom using industry-standard OAuth protocols:

• Live classes utilize your own Bring-Your-Own (BYO) Zoom account. Audio and video streaming is carried over Zoom’s network with zero per-minute streaming fees charged by Learnbird.
• Learnbird automates meeting scheduling, access verification, and student attendance logs. You agree to comply with Zoom’s Terms of Service and Community Standards during all live lectures.

6DRM & Content Anti-Piracy Protection

Learnbird equips video assets with multi-layer anti-piracy protections:

• Video streams are secured using HMAC-SHA256 time-limited signed tokens and adaptive bitrate HLS delivery.
• Dynamic student watermarking projects the viewer's identity onto lecture players to deter unauthorized screen captures.
• Any user attempting to scrape, reverse-engineer, or circumvent video security will have their access terminated immediately.

7Subscriptions, Quotas & Add-On Boosters

• Billing Cycles: SaaS subscriptions (Starter Pro, Batch Pro, Academy) are billed on a recurring monthly or annual basis. Annual subscriptions include 2 months free.
• Quota Enforcement: Enrolled active students and total video storage are monitored against plan limits. When approaching quotas, administrators can purchase instant expansion boosters (Storage or Student Boosters) without changing their core plan.
• Cancellation: You may cancel your subscription at any time via your billing dashboard. Access remains active until the end of the current paid billing period.

8Governing Law & Limitation of Liability

These Terms are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the commercial courts of Colombo, Sri Lanka.

In no event shall CEYBYTE (Pvt) Ltd be liable for indirect, punitive, or consequential damages resulting from lost profits, third-party internet outages, or educator-student fee disputes.
